Debt Formalisation Process

Another option to consider is that of formalising the debt. This involves an application to have the debt formally declared and then optionally converting that declaration to a Magistrates Court Order. Victorian members can consider seeking the declaration of a debt by VCAT (Victorian Civil Administrative Tribunal).

It will cost $38.50 to lodge an application (for matters up to $10,000).

More information about this can be found in VCAT’s Civil Claims Guide. Click here for VACAT's Civil Claims Guide. This also has an Application Form. Click here for Civil Claims Application Form
If a debt is declared by VCAT to exist, the option is then available to have this declaration converted into a Magistrates Court Order. Cost of this is $137.

If the Court Order then remains undischarged, debt recovery action may then result in action including, but not limited to, possible forfeiture of property.
