Policy win - New Road Rule 79A Expansion – Effective July 1, 2025

 

In a major win by the VACC Towing Operator’s Division (TOD) the Department of Transport and Planning (DTP) has announced an expansion to Road Rule 79A, which will come into effect on July 1, 2025. This rule mandates that motorists must slow down to 40 km/h when passing stationary or slow-moving vehicles (travelling at 10 km/h or less) displaying flashing lights and with workers on the roadside.

 

Previously applicable to emergency and law enforcement vehicles, this rule will now extend to include:

• Accident towing vehicles

• Breakdown towing services

• Roadside assistance vehicles

• Incident response services

The inclusion of these vehicles aims to enhance the safety of workers attending to incidents on the roadside. Motorists are required to reduce their speed to 40 km/h when passing these vehicles, regardless of the road type, including freeways. This measure is consistent with existing speed restrictions in school zones and road work areas.

 

Implications for Towing Operators

As operators within the towing industry, it is crucial to understand the implications of this rule change:

  • Enhanced Safety Measures: The reduced speed limit for passing vehicles provides a safer environment for towing personnel working on or near roadways.
  • Public Awareness: There may be an adjustment period as the public becomes accustomed to the new rule. Operators should remain vigilant and continue to prioritise safety during roadside operations.
  • Compliance: Ensure that all towing vehicles are equipped with functioning flashing lights to alert oncoming traffic, as stipulated by the new rule.

Special Acknowledgement

VACC acknowledges and appreciates the Towing Division Executive Committee's leadership in achieving this positive regulatory change for both towing members and the broader motoring public.  While there is no requirement for a change of lights at this stage, it is the committee’s view that magenta lights should be assigned to towing operators and will be pursuing this with DTP directly.
